What Is Legal Aid? 

Legal aid is public funded support for those who cannot afford legal advice. In the context of family matters this can help with initial guidance, private mediation or court representation. Essentially this covers specialist advice from a solicitor, the preparation of your case and representation at the hearing. In some instances it will also cover assistance with family mediation. Legal aid is managed by the Legal Aid Agency. They decide who qualifies and the type of support that will be provided. Furthermore, what legal aid you need depends on the circumstances of your case and is filtered through three considerations. 

What Are The Considerations For Legal Aid? 

When deciding if your case qualifies for legal aid help the agency will consider the following;

Scope

Firstly, they will assess if your case falls within the scope of legal aid. For family law this primarily includes protection from domestic abuse, child protection proceedings, abduction and forced marriages. Additionally, public law proceedings for children and financial support for family mediation can also qualify. So, to be successful there normally has to be evidence of domestic abuse which can come from a variety of sources. You can ask the courts, social services or even your employer to provide evidence to help with your application. 

Means

Next, the agency will consider your financial situation. There are two types of cases, some do not come under the means test. Effectively this means regardless of income they can receive the aid. The income threshold from April 2025 is £2657 per month plus an additional £222 per child if you have over four children. 

Merits

If they decide the case has over a 50% chance of success and the costs are proportionate to the outcome, it is likely you will qualify.

Make sure that you are in the financial umbrella. You can check your financial eligibility via the government website here. Lastly, be prepared to provide evidence of your gross income, disposable income and financial assets. 

Search For A Legal Aid Solicitor

You must find a solicitor that provides legal aid. When they agree to take on your case they will have to apply to the agency for funding. They will likely ask you to submit certain documents. So, being as prepared as possible will assist with your application. 

What Happens If You Qualify For Legal Aid?

If you qualify your solicitor will take on the case. You will receive a certificate outlining the amount you can spend and type of aid you will receive. You may pay extra for further legal advice that does not fall within the support. Effectively this means you can use both a legal aid solicitor and a private family lawyer at the same time.
